10.4.18 - On October 4, 2018, Presiding L.A. County Superior Court Judge Daniel Buckley overruled Defendant Southern California Edison’s demurrer in the Thomas Fires consolidated cases. In its pleadings, SCE demurred to Plaintiffs’ inverse condemnation cause of action. The judge’s tentative ruling observed the state’s law holding utilities financially liable when their equipment is determined to be the cause of a fire. Jang & Associates is part of the subrogation plaintiffs’ team that successfully challenged SCE’s demurrer.

9.17.18 After the Supreme Court denied PG&E’s petition for writ of mandate in the North Bay Fires cases, the California’s 1st District Court of Appeal has also summarily denied the writ in an order published September 17, 2018. The writ was filed in an effort to overturn the trial court’s decision on PG&E’s demurrer of May 18. In its demurrer, PG&E argued that applying inverse condemnation in the North Bay Fires case would violate the utility’s due process rights. Managing partner Alan Jang authored the Subrogation Plaintiffs’ opposition to the demurrer.
